Garanties légales
Legal guarantees
Two guarantees apply to everything sold here, by law, at no cost to you. They are set out separately below because they are separate rights with different time limits and different remedies. They apply in addition to your right to withdraw, and you may choose whichever suits you.
1. The legal guarantee of conformity
Articles L. 217-3 to L. 217-20 of the Code de la consommation. CHANA MOD delivers goods that conform to the contract and answers for any lack of conformity existing at the time of delivery.
How long you have
- Two years from the day the goods are delivered.
- For the first twenty-four months, any lack of conformity that appears is presumed to have existed at delivery. You do not have to prove it — we have to prove otherwise if we dispute it.
- Where a piece is repaired under this guarantee, the guarantee is extended by six months. Where it is replaced, a fresh two-year period starts on the replacement.
What you can ask for
- Repair or replacement, at your choice. We may choose the other option only where your choice would cost us manifestly disproportionately more, and we must then act within thirty days and at no cost to you.
- A price reduction, or cancellation of the sale with a full refund, where repair and replacement are impossible, where we fail to carry out the remedy within thirty days, where a remedy causes you a major inconvenience, or where the lack of conformity is serious enough to justify it immediately.
The remedy costs you nothing: no carriage, no labour, no parts. Cancellation is not available where the lack of conformity is minor.
What counts as a lack of conformity
- the piece does not match the description, the fibre composition or the photographs;
- the flat measurements fall outside the tolerance of plus or minus one centimetre stated on the piece;
- the opacity rating on the page does not match the cloth you received;
- a seam, fastening or finish fails in normal wear, in a way ordinary use would not explain;
- the care label conflicts with the fibre composition.
Behaviour we described in advance is not a lack of conformity. Linen creases, satin marks under pressure, indigo transfers colour, wool and alpaca pill, and a bias hem settles unevenly — each of these is written on the piece concerned before you buy, precisely so it cannot come as a surprise.
2. The guarantee against hidden defects
Articles 1641 to 1649 of the Civil Code. This is a separate guarantee and it stands on its own.
What it covers
A hidden defect is one that existed when you bought the piece, that could not be seen on a reasonable inspection, and that makes the piece unfit for what it is meant for, or so reduces its usefulness that you would not have bought it, or would have paid less, had you known.
How long you have
- Two years from the discovery of the defect, within an overall limit of five years from the sale.
What you can ask for
- Return the piece and be repaid in full (the action rédhibitoire); or
- Keep the piece and have part of the price returned (the action estimatoire).
In either case you may also claim damages where the defect has caused you a loss. You choose between the two; we cannot choose for you.
How to claim under either guarantee
- Write to support@chanamod.space or call +33 7 97 03 97 45. Give your order reference, describe the problem and attach photographs if you can.
- We reply within one working day and tell you what we propose.
- Where the piece needs to come back to us, we pay the carriage and send a prepaid label. You never pay to exercise a legal guarantee.
- We carry out the remedy within thirty days of the piece reaching us, and keep you informed if anything is likely to take longer.
Postal address for claims: 41 Rue Sedaine, 75011 Paris, France.
No commercial guarantee is added
We do not sell or offer an extended commercial guarantee. Nothing on this site restricts or replaces the two legal guarantees above, and no clause anywhere in our terms can limit them.
If we cannot agree
You may refer the dispute free of charge to a consumer mediator, or use the European online dispute resolution platform. Both routes are on the mediation page. You keep the right to go to court, and using a guarantee does not affect your right to withdraw.
